Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Renter", "you", "your") and Morocco 4×4 Cars ("Company", "we", "us", "our"), a car rental service located at M'Hamid, Maatallah, No. 912 Marrakech, Morocco.

By accessing our website, making a reservation, or renting a vehicle from us, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services.

Driver Eligibility

To rent a vehicle from us, you must:

• Be at least 21 years of age (25 years for luxury and 4×4 vehicles)
• Hold a valid driver's license for at least 1 year (3 years for certain vehicle categories)
• Present a valid passport or national ID card
• Provide a valid credit or debit card in your name for security deposit
• Meet our insurance and credit requirements

Additional Drivers

Additional drivers must meet the same requirements and be registered at the time of rental. An additional driver fee of 50 MAD per day applies. Only registered drivers are permitted to operate the vehicle.

Reservation Process

• All reservations must be made through our website, phone, or email
• Reservations are confirmed upon receipt of booking confirmation
• We reserve the right to refuse any reservation at our discretion
• Vehicle availability is subject to confirmation
• Minimum rental periods may apply depending on location and season

Vehicle Substitution

While we strive to provide the exact vehicle reserved, we reserve the right to substitute a vehicle of similar or higher category at no additional cost if the reserved vehicle becomes unavailable due to circumstances beyond our control.

Cancellation Policy

• More than 48 hours before pickup: Full refund
• 24-48 hours before pickup: 50% cancellation fee
• Less than 24 hours or no-show: 100% cancellation fee
• Refunds will be processed within 7-14 business days

Rental Rates

• All prices are quoted in Moroccan Dirham (MAD) and can be viewed in EUR, USD, or GBP
• Rates may vary by location, season, and vehicle type
• Seasonal pricing applies during peak periods (summer, holidays, festivals)
• Delivery and collection fees apply for locations outside Marrakech city center
• Airport delivery and pickup within Marrakech are complimentary

Payment Methods

We accept the following payment methods:

• Online Payment: Credit/debit cards via secure CMI payment gateway
• Pay on Collection: Cash or card payment at vehicle pickup
• Accepted cards: Visa, Mastercard, American Express

Security Deposit

A security deposit is required for all rentals:

• Deposit amount varies by vehicle category (typically 5,000-15,000 MAD)
• Must be paid by credit/debit card (cash deposits not accepted)
• Held as pre-authorization on your card
• Released within 7-14 days after vehicle return, subject to inspection
• May be used to cover damages, fuel charges, traffic fines, or contract violations

Additional Fees

• Fuel: Vehicle must be returned with same fuel level, or refueling fee applies
• Late return: Charged at daily rate plus 20% after 2-hour grace period
• Cleaning fee: Applied if vehicle returned excessively dirty
• Traffic fines: Plus administrative fee of 200 MAD per fine
• Optional extras: Baby seat, GPS, WiFi, additional driver, etc. (50-150 MAD/day)

Included Coverage

All rentals include:

• Third-Party Liability Insurance: As required by Moroccan law
• Collision Damage Waiver (CDW): With excess/franchise (deductible)
• Theft Protection: With excess/franchise
• 24/7 Roadside Assistance: Emergency support throughout Morocco

Excess/Franchise

The renter is responsible for the excess amount in case of:

• Accident or collision damage (excess typically 5,000-15,000 MAD)
• Theft or attempted theft
• Windscreen, glass, tires, or undercarriage damage
• You may purchase Partial Franchise Reduction (50% reduction) for 150 MAD/day

Coverage Exclusions

Insurance does NOT cover:

• Damage caused by driver negligence, recklessness, or violation of terms
• Driving under influence of alcohol or drugs
• Off-road driving (unless specifically authorized for 4×4 vehicles)
• Interior damage, lost keys, or personal belongings
• Damage to roof, undercarriage from improper use
• Unauthorized drivers or passengers
• Mechanical breakdown due to misuse

Permitted Use

• Vehicles may only be driven in Morocco
• Must be operated on paved roads (unless 4×4 authorized for off-road)
• Only registered drivers may operate the vehicle
• Must comply with all Moroccan traffic laws and regulations

Prohibited Use

The following are strictly prohibited:

• Racing, competitions, or speed testing
• Transporting passengers or goods for hire
• Towing or pushing other vehicles
• Carrying illegal goods, drugs, or contraband
• Smoking in vehicles (500 MAD cleaning fee applies)
• Transporting pets without prior authorization
• Driving while impaired by alcohol, drugs, or medication
• Using vehicle for driving lessons
• Exceeding passenger capacity

Vehicle Pickup

• Present valid driver's license, passport, and credit card
• Inspect vehicle with our agent and note any pre-existing damage
• Sign rental agreement and damage report
• Receive keys, documents, and emergency contact information
• Vehicle is provided with full tank of fuel

Vehicle Return

• Return vehicle at agreed date, time, and location
• Return with same fuel level (full tank)
• Vehicle will be inspected for damage
• Return all keys, documents, and equipment provided
• Late returns incur additional charges after 2-hour grace period

Grace Period

A 2-hour grace period is provided for returns. Returns exceeding this period will be charged an additional day's rental plus 20% late fee.

In Case of Accident

• Immediately contact us at +212 6 33 33 74 32
• Contact local police and obtain accident report (constat amiable)
• Do not admit liability or sign any documents without our approval
• Take photos of damage and exchange information with other parties
• Complete our accident report form within 24 hours
• Failure to report may result in loss of insurance coverage

Breakdown Assistance

• Contact our 24/7 roadside assistance: +212 6 33 33 74 32
• Do not attempt repairs yourself or use unauthorized mechanics
• We will arrange towing or repairs at our expense (if not due to misuse)
• Replacement vehicle provided if breakdown exceeds 24 hours (subject to availability)

Your personal information is processed in accordance with our Privacy Policy. By using our services, you consent to:

• Collection and processing of personal data for rental purposes
• Storage of data using Convex database and Clerk authentication
• Email communications via Resend email service
• Payment processing through CMI payment gateway
• Sharing data with authorities if required by law

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for personal belongings left in vehicles
• We are not liable for delays, cancellations due to force majeure
• Our total liability is limited to the total rental fee paid
• You agree to indemnify us against claims arising from your use of the vehicle

Dispute Resolution

In the event of any dispute:

• First contact us to resolve the matter amicably
• If unresolved, disputes shall be subject to mediation
• Governed by the laws of Morocco
• Exclusive jurisdiction of courts in Marrakech, Morocco

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the modified Terms. We will notify you of material changes via email or website notice.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and rental agreement, constitute the entire agreement between you and Morocco 4×4 Cars regarding the rental of vehicles and supersede all prior agreements and understandings.
